Subscription & Payment Info

Payment is charged to App Store account at confirmation. Subscription is renewed unless turned off 24h before the period ends. In this case, account will be charged for renewal as well. You may turn it off your account settings. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

By downloading or using Migmig Games, these terms will automatically apply to you – you should therefore make sure that you read them carefully before using our games. You’re not allowed to copy or modify Migmig Games, any part of our games, or our trademarks in any way. You’re not allowed to attempt to extract the source code of our games, and you also shouldn’t try to translate our games into other languages, or make derivative versions. Migmig Games itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, still belong to Migmig.

We are committed to ensuring that our games is as useful and efficient as possible. For that reason, we reserve the right to make changes to our games or to charge for its services at any time and for any reason. We will never charge you for our games or its services without making it very clear to you exactly what you’re paying for.

Migmig Games stores and processes personal data that you have provided to us in order to provide our Service. It’s your responsibility to keep your phone and access to our games secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware, viruses, malicious programs, compromise your phone’s security features and it could mean that our games won’t work properly or at all.

You should be aware that there are certain things that we will not take responsibility for. Certain functions of our games will require our games to have an active internet connection. The connection can be Wi‑Fi or provided by your mobile network provider, but we cannot take responsibility for our games not working at full functionality if you don’t have access to Wi‑Fi and you don’t have any of your data allowance left.

If you’re using our games outside of an area with Wi‑Fi, you should remember that your agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing our games, or other third‑party charges. In using our games, you’re accepting responsibility for any such charges, including roaming data charges if you use our games outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using our games, please be aware that we assume that you have received permission from the bill payer for using our games.

Along the same lines, we cannot always take responsibility for the way you use our games, i.e. you need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, we cannot accept responsibility.

With respect to our responsibility for your use of our games, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. We accept no liability for any loss, direct or indirect, that you experience as a result of relying wholly on this functionality of our games.

At some point, we may wish to update our games. Our games is currently available on – the requirements for system (and for any additional systems we decide to extend the availability of our games to) may change, and you’ll need to download the updates if you want to keep using our games. We do not promise that we will always update our games so that it is relevant to you and/or works with the version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing our games and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination: (a) the rights and licenses granted to you in these terms will end; and (b) you must stop using our games and (if needed) delete it from your device.

Changes to These Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.

These Terms of Service (“Agreement”) govern the relationship between the user and Migmig Hub AI (“Migmig”) regarding use of Migmig Hub AI games and related services (“Services”) provided by Migmig via the Apple App Store and Google Play Store.

Please read this Agreement and our Privacy Policy carefully before you start using, downloading, or accessing the Services.

By using Services in any way, you represent that you are older than 18 or older than 16 and your parent or guardian has reviewed and accepted this Agreement. Services will not be provided to those younger than 16 years old.

Commercial use of Services is prohibited and use for commercial purposes is unlawful. To this end, you acknowledge and accept that you use the Services for entertainment purposes within personal use.

By using the Services or downloading any of our games from app stores, you accept the Agreement. If you do not agree to the Agreement, you may not use or otherwise access the Services.

Right of Use of Services

Right of Use

Without prejudice to other provisions of this Agreement, Migmig Games grants users a non‑exclusive, non‑transferable, non‑sublicensable, revocable limited right subject to the limitations below to access and use the Service. As part of this right of use, users may only access or use Services for their personal and non‑commercial entertainment purposes.

Liabilities of the User

The rights granted to users in this Agreement are subject to the following restrictions:

• Users shall not license, sell, rent, lease, transfer, assign, distribute, copy, communicate to the public, represent, publish, or otherwise commercially exploit the Service;
• Users shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer the Services in whole or in part;
• Users shall not access the Services in order to build a similar or competitive service or application;
• Except as expressly stated herein, no part of the Service may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means.

The users undertake that they shall not conduct any of the following actions under this Agreement:

• Access to and use of Migmig Hub AI’s information systems;
• Initiate or attempt an attack on Migmig Hub AI’s information systems or spread attack‑supporting viruses;
• Disable or change software that Migmig Hub AI uses regarding cybersecurity;
• Send invitations, advertisements or e‑mails on Migmig Hub AI’s behalf by using Migmig Hub AI trademarks and logos;
• Make any sexually explicit, obscene, or racist posts, or posts about children, on behalf of Migmig Hub AI, or mention the name or logo of Migmig.

Intellectual Property Rights

The Services provided to the users under this Agreement are not sold; users are only given the right of use as explained under Article 1 above.

Migmig Hub AI owns all rights, title and interest, including without limitations any games, titles, computer code, themes, objects, characters, character names, stories, in‑game dialogues, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio‑visual effects, methods of operation, documentation, character profile information, accounts, virtual currency and virtual items, and material produced by Migmig Hub AI and/or received or made available while playing the games or developed during the course of the games, and all related intellectual property rights in relation to the Services.

Copyright, trademarks, and all other proprietary rights displayed in the Services (including, but not limited to, software, graphics, and logos) belong to Migmig Hub AI. Unless otherwise stipulated under this Agreement, the users are not allowed to copy, use, republish, modify, download, distribute, license or reverse engineer.

Virtual Elements

Migmig Hub AI games contain virtual game currencies (“Virtual Currency”), such as coins, cash, and/or diamonds, that are used to purchase virtual items (“Virtual Items”) (“Virtual Currency” and “Virtual Items” shall be referred to collectively as “Virtual Elements”). The users may purchase a limited, personal, non‑transferable, non‑sublicensable and revocable license to use the Virtual Elements. Platform providers and payment service providers conduct all payment transactions related to the Virtual Elements. By purchasing in‑game Virtual Elements, the users agree to the terms of service of platform providers and payment service providers.

Virtual Elements cannot be exchanged with Migmig Hub AI or any third party for real money, goods, products or services. Migmig Hub AI has no liability for hacking or loss of the users’ Virtual Elements. The price and availability of Virtual Elements may be reorganized, changed or disallowed by Migmig Hub AI at any time, with or without notice. Refunds related to the Virtual Elements are processed by the relevant platform providers subject to their policies.

Warranty Disclaimer

Migmig Hub AI provides the Services to the users on an “as is” basis without any warranties of any kind. Migmig Hub AI does not warrant that the users will be able to access or use the Services at the times and locations of the users’ choosing; that Services will be uninterrupted or error‑free; that defects will be corrected; or that the Services will be free of viruses or other harmful components.

Limitation on Liability

In no event shall Migmig Hub AI be liable to the users or any third party for any indirect, incidental, consequential, special or punitive damages, including but not limited to loss of revenue, lost profits or business interruption, arising from or in relation to the Agreement. Access to and use of the Services are at the users’ own discretion and risk, and the users will be solely responsible for any damage to their mobile device resulting therefrom. Migmig Hub AI’s liability will be limited to fixing access‑related problems. Migmig Hub AI’s liability arising from or in relation to the Agreement shall not exceed the amount that the user has paid to Migmig Hub AI in accordance with the Agreement in the six (6) months immediately preceding the date on which the user first asserts a claim. The users agree that if they have not paid anything to Migmig Hub AI during such time period, their sole remedy for any dispute with Migmig Hub AI is to discontinue using the Services.

Indemnity

The users agree to defend, indemnify and hold harmless Migmig Hub AI from and against any claims, suits, damages, indemnification claims, or expenses including reasonable attorneys’ fees brought by third parties resulting from or relating to use of the Services, user content, or users’ violation of this Agreement.

Modifications

Migmig Hub AI reserves the right to amend the provisions of the Agreement at any time. The latest version of the Agreement will be published on Migmig Hub AI’s website.

Term and Termination

This Agreement shall enter into force on the date of activation or use of Services by the user. The users will be assumed to have accepted this Agreement and any amendments thereof by activating, downloading or using the Services.

This Agreement shall be effective for the period of use of the Services and shall terminate if the user discontinues using the Services or if this Agreement is terminated by Migmig Hub AI.

Dispute Resolution and Applicable Law

This Agreement and all disputes relating to the performance or interpretation of any term of this Agreement shall be construed under and governed by Turkish Law, without regard to any conflict of law principles. All disputes or claims arising out of or in connection with this Agreement shall be finally settled by Istanbul Central (Çağlayan) Courts and Enforcement Offices.

Notices

Migmig Hub AI may notify the users via postings on its website or in the games and via the e‑mail address provided by the user. All notices required from the user as per the Agreement shall be made to info@migmigx.com.
